What is the regulatory framework for fiber optics in apartment buildings?

A series of regulatory measures legitimises the request to have fiber optics in apartment buildings: Legislative Decree no. 259/2003 “Electronic Communications Code” Art.90 and 91; Law no. 133/2008, no. 112; Legislative Decree no. 33/2016 “Fiber Decree”; Law no. 120/2020 converting Legislative Decree no. 76/2020 (“Simplification Decree”); Law no. 27/2020 converting Legislative Decree no. 18/2020 (“Cure Italy”).                    

These regulations stipulate that the appointed technician may enter the common areas of buildings to carry out installations, without the need for a building resolution. During the fiber-optic network development phase, the technician may access the spaces affected by the activities to install, connect and maintain the system, including in uninhabited and newly constructed buildings.

(Leg. Decree 259/2003 “Electronic Communications Code”, art. 91; ld 25 June 2008, no. 112 conv. into l. no. 133/2008; Leg. Decree no. 33/2016 “Fiber Decree”):

The law gives operators the right to access the inside of buildings to install the systems. During the fiber optic network development phase, the operator may access the spaces affected by the activities to install, connect and maintain the system also in uninhabited and newly constructed buildings. Condominium approval is not required to access the building.
